These Terms & Conditions ("Terms") govern the relationship between you ("User", "Customer", or "Client") and HostGanga, a brand owned and operated by Nexaroot Technology India Private Limited, a company incorporated under the Companies Act, 2013, India. By accessing or using HostGanga services, you agree to be legally bound by these Terms.
ELIGIBILITY & USER RESPONSIBILITY
Users must be at least 18 years of age or legally eligible to enter into binding contracts. Entity users confirm that the registering person has full authority to bind the organization. Users are solely responsible for all activities performed under their account.
SCOPE OF SERVICES
HostGanga provides hosting and infrastructure services including shared hosting, reseller hosting, VPS, cloud hosting, dedicated servers, domains, email services, and related solutions. Service specifications are defined at the time of purchase and may change over time.
PAYMENT & BILLING
All services are prepaid unless explicitly stated otherwise. Users must pay all applicable fees, setup charges, renewal charges, and taxes including GST. Failure to make timely payment may result in service suspension or termination.
RENEWAL & SUSPENSION
Services renew automatically unless cancelled before the renewal date. Expired services may be suspended or terminated, and associated data may be permanently deleted. HostGanga is not responsible for losses caused by delayed or missed renewals.
ACCEPTABLE USE POLICY
Users must not use HostGanga services for illegal activities, spam, phishing, malware hosting, hacking attempts, copyright infringement, or any activity that violates Indian law or network integrity.
SECURITY RESPONSIBILITY
Users are fully responsible for securing their websites, applications, scripts, passwords, and server configurations. HostGanga shall not be liable for security breaches caused by weak credentials, outdated software, or misconfigurations.
DATA & BACKUPS
While HostGanga may offer backup services, Users remain solely responsible for maintaining their own backups. HostGanga shall not be liable for data loss, corruption, or accidental deletion.
UPTIME & MAINTENANCE
HostGanga strives for high service availability but does not guarantee uninterrupted uptime. Scheduled maintenance, upgrades, or third-party outages may result in downtime without liability.
TERMINATION OF SERVICE
HostGanga reserves the right to suspend or terminate services immediately for policy violations, non-payment, security threats, or legal requirements, without prior notice.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, HostGanga shall not be liable for indirect, incidental, or consequential damages including loss of data, revenue, or business opportunities. Total liability shall not exceed the amount paid for the affected service.
GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of India. Courts located in India shall have exclusive jurisdiction over any disputes.
GENERAL TERMS
If any provision of these Terms is held invalid, the remaining provisions shall remain enforceable. These Terms constitute the entire agreement between the User and HostGanga.
